American Trust Investment Advisors provides services as a Personal Trustee – providing total responsibility for investing and administering trusts for the benefit of individuals and their families. Numerous Advantages of New Hampshire Trusts

Favorable tax environment in New Hampshire. As many people know, The State of New Hampshire is famous for low taxes. While there are interest and dividend taxes, there is no capital gains tax in New Hampshire. Residents also appreciate that there is no income tax or sales tax. There are other tax advantages depending on the type of trust you establish or transfer to us. We are glad to work with your attorney or assist you in exploring these advantages.

Trusts in perpetuity are allowed in New Hampshire. The State has abolished the common law rule against perpetuities. This allows an individual to establish a trust in New Hampshire that will continue as long as they would like.

Clear and flexible rules for grantors of trusts. In 2004, New Hampshire took a step forward in improving its trust laws by adopting the Uniform Trust Code (UTC). Two years later, New Hampshire passed The Trust Competitiveness and Modernization Act of 2006 (TMCA) allowing even greater flexibility in the handling and administration of trusts. This new Act also provides greater freedom for those establishing trusts to control the rules governing trusts. Also, greater latitude was provided for “directed trusts,” “trust protectors” and other fiduciaries that often work in tandem with traditional trustees.

As part of the TMCA, the Uniform Principal and Income Act was passed. This allows settlors greater freedom to control the rules of their trusts. For example, a trust that is allowed to distribute income only to the beneficiary is provided the flexibility to distribute capital gains to the beneficiary, thereby allowing for total return investing.
